These Terms of Service ("Terms") govern your use of the Sports Safe website and services, provided by CG to the Max LLC ("Sports Safe," "we," "us"). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.
Safety disclaimer and assumption of risk — please read carefully
Sports Safe is a monitoring aid intended to support trained staff. It is not a substitute for official weather warnings, established emergency action plans, or the judgment of the people on site. Weather data can be delayed, incomplete, or inaccurate, and alerts may fail to arrive, and the absence of an alert is not a representation that conditions are safe. You are solely responsible for decisions about whether to begin, continue, stop, or resume any practice, game, or other athletic activity, including decisions made in reliance on, or in the absence of, an alert from the service. Always follow your local safety authorities and your organization's policies, and when in doubt, stop play. Sports Safe never guarantees safety and never indicates that any person or field is "protected." By using the service, you and your organization expressly assume all risks associated with weather-related and other conditions affecting athletic activity, and you acknowledge that our role is limited to providing supplemental information — not making or directing safety decisions.
The service
Sports Safe monitors weather-related conditions — including lightning, heat, UV, and severe-weather alerts — for locations you add, and delivers notifications based on your settings. Features, data sources, and availability may change over time.
Assumption of risk
Outdoor and indoor athletic activity carries inherent risks, including risks from lightning, extreme heat, severe weather, and other hazardous conditions. By using the service, you acknowledge and agree that: (a) the decision to begin, continue, stop, or resume any practice, game, or activity is made solely by you, your organization, or the individuals on site, and not by Sports Safe; (b) you expressly assume all risks arising from weather-related and other on-site conditions, whether or not Sports Safe issues an alert; and (c) no output of the service — including the absence of an alert — constitutes a representation, warranty, or guarantee that any location, activity, or time period is safe.
Your account
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to keep it current. Notify us promptly of any unauthorized use.
Subscriptions and billing
Paid plans are billed on the cycle you select (monthly or annual). Fees are charged in advance and, except where required by law, are non-refundable. We may change pricing with reasonable notice. Subscriptions renew automatically unless cancelled before the renewal date. Purchases made through the Apple App Store are also subject to Apple's terms.
Acceptable use
You agree not to misuse the service, including by attempting to disrupt it, access it without authorization, reverse-engineer it, or use it for any unlawful purpose.
Intellectual property
The service, including its software, content, and branding, is owned by CG to the Max LLC and protected by applicable laws. We grant you a limited, non-exclusive, non-transferable right to use the service in accordance with these Terms.
No warranty
The service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted, timely, secure, or error-free, or that weather data or alerts will be accurate or delivered, and we do not warrant the completeness, timeliness, or accuracy of any weather data, forecast, or alert, including data or alerts generated using information from third-party weather-data providers.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, AND REGARDLESS OF WHETHER A CLAIM IS BASED IN CONTRACT, TORT (INCLUDING SPORTS SAFE'S OWN NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, CG TO THE MAX LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, LOSS OF LIFE, OR PROPERTY DAMAGE, ARISING OUT OF OR RELATED TO YOUR USE OF — OR INABILITY TO USE — THE SERVICE, OR YOUR OR ANY THIRD PARTY'S DECISION TO BEGIN, CONTINUE, STOP, OR RESUME ANY ATHLETIC ACTIVITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (I) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (II) ONE HUNDRED DOLLARS ($100). NOTHING IN THESE TERMS LIMITS LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR ANY LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
Indemnification
You agree to indemnify, defend, and hold harmless CG to the Max LLC and its affiliates, officers, and employees from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the service; (b) your or any third party's reliance on, or decisions made in connection with, weather data or alerts provided by the service; (c) your violation of these Terms; or (d) your violation of any law or the rights of a third party.
Termination
We may suspend or terminate your access to the service at any time if you violate these Terms or if we discontinue the service. You may stop using the service and close your account at any time.
Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any disputes will be resolved in the state or federal courts located in Texas.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the service after changes take effect constitutes acceptance.
